These Terms of Service ("Terms") are a legal agreement between you and Garded LLC ("Garded", "we", "us", "our") and govern your use of the Carzam app and related services ("Carzam"). By downloading or using Carzam, you agree to these Terms. If you don't agree, don't use Carzam.
1. What Carzam does
Carzam uses artificial intelligence to identify vehicles from photos and to provide related information, including specifications, pricing, market value estimates, rarity scores, and facts.
2. AI estimates — important
All identifications and information in Carzam are AI-generated estimates and may be inaccurate, incomplete, or out of date. This includes make/model, specifications, MSRP, current market value, production numbers, rarity scores, 0–60 times, top speeds, and any other figure. Do not rely on Carzam for any purchase, sale, insurance, appraisal, financial, safety, or legal decision. Market values and rarity scores are not appraisals. Always verify independently before acting on any information in the app.
3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Carzam for your own personal, non-commercial use, subject to these Terms and the Apple App Store Terms of Service.
4. Acceptable use
You agree not to: abuse, overload, or disrupt the service; reverse-engineer, decompile, or circumvent the app's security (including App Attest) or rate limits; scrape, resell, or commercially exploit the service or its outputs; use Carzam unlawfully; or submit photos you do not have the right to use or that contain other people's private information without permission.
5. Your content
You retain ownership of the photos you scan. You grant us a limited license to process those photos solely to provide the identification feature. Your scans are stored on your device under your control.
6. Intellectual property
Carzam, including its name, design, and original content, is owned by us or our licensors. Vehicle manufacturer names, models, logos, and trademarks shown in the app belong to their respective owners and are used solely for identification and reference. Carzam is an independent app and is not affiliated with, sponsored by, or endorsed by any vehicle manufacturer.
7. Third-party services
Carzam relies on third-party services (including Google and Cloudflare). Their availability, changes, or terms may affect Carzam, and we are not responsible for third-party services.
8. Disclaimers
Carzam is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Carzam will be uninterrupted, error-free, or accurate.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your reliance on information in Carzam. Our total liability for any claim is limited to the greater of the amount you paid for Carzam in the prior 12 months or USD $10.
10. Changes and termination
We may modify, suspend, or discontinue Carzam or these Terms at any time. We may suspend or terminate your access for violation of these Terms. Continued use after changes means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Dover, Delaware.
